1. Introduction
This Privacy Policy (hereinafter referred to as the “Policy”) discloses the privacy practices for EKSAQ India Pvt Ltd on behalf of itself, its affiliates and subsidiaries (hereinafter referred to as the “Company”), under the brand “EKSAQ” with regard to collection and use of the Personal Information (defined hereunder) pertaining to all Users of the Services, (referred to as “You” or “Users” in this Policy).
The Company is the creator, owner and publisher of the mobile web application EKSAQ EDTECH LLP & EKSAQ INDIA PRIVATE LIMITED (referred to as the “App” or the “Application” or “Platform” or referred to as “us” or “we” in this Privacy Policy).
“Products” refers to the educational technology applications designed to enhance learning and development through digital platforms by the Company. “Services” refers to the Services made available to Users through the App and further defined in the Terms of Use governing access and use of the App.
This Policy along with Terms of Use describes our practices regarding, including your choices in relation to how we collect, store, use, share and secure your Personal Information (defined hereunder) across our website. It also describes your choices regarding use, access and correction of your Personal Information and your rights in relation to your Personal Information and how to contact us or supervisory authorities in the event you have a complaint.
All statements in this Privacy Policy apply to all Users who are required to read and understand this Privacy Policy prior to using the Services and/or providing information to the Company. This Privacy Policy shall be treated as a part of the Terms of Use of the App and shall be read in conjunction with the Terms of Use.

3. How We Use Your Information
We use the Personal Information we collect, where it is necessary to deliver the Services you have requested, and where it is necessary to exercise or comply with legal rights or obligations or for the purpose set out in this Policy.
We will use your Personal Information to provide, analyse, administer, and improve our Services, to provide you with a personalised experience on our App, to contact you about your account and our Services, to provide you customer service, personalised marketing and to detect, prevent, mitigate and investigate fraudulent or illegal activities.

If you have filled out a user profile, we will provide an obvious way for you to access and change your profile from our Application. The Users can exercise their rights enumerated herein. In case it is required to extend the period of retention of such data, we shall obtain your consent for the same. Further, we may also dispose of the data prior to completion of the period of retention, if the purpose for which it was collected is fulfilled.

We shall try to take all precautions to protect the Personal Information both online and offline. We will try to protect your information using technical and administrative security measures to reduce the risks of loss, misuse, unauthorised access, disclosure, and alteration. We have standard SSL certification which basically helps us create a secure connection between our server and user to render any information or action. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centres and information access authorization controls. Only user passwords are encrypted using bcrypt and stored because generally users use the same password on multiple sites, to prevent any kind of theft, piracy, or unauthorised access. We may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve our customised content. Clicking on links may take you to sites outside our App. We are not responsible for the privacy practices of other applications. We encourage our users to be aware when they leave our App to read the privacy statements of each and every Application and/or website that collects personally identifiable information. This Privacy Policy applies solely to information collected by our App.

We may alert you by email or phone (through sms/call/whatsapp) to inform you about new service offerings of the Company and its subsidiaries/affiliates or other information which we feel might be useful for you, through the Company or its subsidiaries/affiliates.

Our App is in accordance with the provisions of the existing applicable laws, including but not limited to the Information Technology Act 20002 (“IT Act”), Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 (“SPDI Rules”), the Protection of Children from Sexual Offences (“POCSO”) Act, 2012, Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2023 (IT Rules 2023), where applicable, the Digital Personal Data Protection Act 2023, the rules and notification proposed thereunder (collectively “Current and Proposed Legislation”).
We do not knowingly collect personal information from children under the age of 13 without verifiable parental consent. Information that may be collected includes a child’s name, age, and educational progress. Any information collected from children is used solely for the purpose of enhancing the educational experience and providing feedback to parents or guardians.
Personal Information collected from children will not be shared with third parties for marketing or advertising purposes.
Data may be shared with service providers who assist in operating our App, provided they comply with strict data protection standards and use the information only for the purposes specified by us.
We employ robust security measures to protect the personal information of children, including encryption, secure servers, and regular security audits.

10. Parental Supervision

The App provides tools to set usage limits and receive regular activity reports. Significant changes to privacy practices will be communicated to parents, and parental consent will be re-obtained if required. The App employs robust security measures to protect children’s Personal Information, including encryption and secure servers. 11. Breach Notification
Where a data breach is likely to result in a risk to the rights and freedoms of individuals, it will be reported to the relevant supervisory authority within 72 hours of the Company becoming aware of it and may be reported in more than one instalment. Users will be informed directly in the event that the breach is likely to result in a high risk to the rights and freedom of that User. If the breach is sufficient to warrant notification to the public, the Company will do so without undue delay.
12. Changes to This Privacy Policy
As the Company evolves, our Privacy Policy will need to evolve as well to cover new situations. You are advised to review this Policy regularly for any changes, as continued use is deemed approval of all changes.

14. Log Information
When you access our App, our servers automatically record information that your browser sends whenever you visit an App. These server logos may include information such as your web request, internet protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

When you send an email or other communication to us, we may retain those communications in order to process your enquiries, respond to your requests, and improve our Services.

18. Governing Law and Jurisdiction
In the event of any dispute arising between the parties with respect to this Agreement, the same shall be referred to the sole arbitrator and the arbitration shall be in accordance with Arbitration and Conciliation Act of 1996. The language of arbitration proceedings shall be English. The seat and place of arbitration shall be HYDERABAD, INDIA and the decision of the Arbitrator shall be final and binding on both parties herein. This contract shall be subject to the exclusive jurisdiction of courts in HYDERABAD, INDIA and shall be governed by the Indian laws.
